Cancellation of Removal or Deportation for Non-Permanent Residents

The cancellation of removal or deportation is often used as a remedy for someone facing deportation proceedings before the immigration court. If the immigrant is eligible and prevails in court, the government will suspend the immigrant's deportation and grant him/her permanent residence in the United States.

To be eligible for cancellation of removal or deportation for non-permanent residents, you must:

  • Have continuously lived in the United States for a minimum of 10 years before the start of your deportation;

  • Be a person of good moral character;

  • Show that your deportation from the United States will result in exceptional and extremely unusual hardship to your spouse, parent, or child United States citizen or lawful permanent resident.
